1) Brighter Web Design will not be held responsible for any material or web content that the client wishes to publish on-line but reserves the right to refuse to publish any material which it deems to be offensive, unlawful, pornographic or plagiarized. In such cases Brighter Web Design may report the client to the appropriate authorities.

2) During development the client’s web site will be published on-line at a web address belonging to Brighter Web Design that is viewable only by the client and Brighter Web Design operatives. Once the web site has been published at the official domain name of the client’s choosing the web site will be deemed to be live.

3) Once the web site is deemed to be live Brighter Web Design will issue an invoice for work completed up to this point. Any further work commissioned by the client following the live publishing of a client’s web site will be invoiced for separately at the end of each calendar month.

4) Payment must be received within 30 days of the date of the invoice. Once payment for the initial site design and publication has been made a CD disk containing the client’s web site will be made available to the client upon request. Any costs incurred from this will be included in the next invoice.

5) If payment is not made Brighter Web Design reserves the right to remove a client’s web site from public view until the account is settled. If removal of the site is not possible Brighter Web Design reserves the right to pursue payment via the small claims court or any other appropriate legal body.

6) Where the setting up of a domain name and web space on a client’s behalf is necessary Brighter Web Design will assist in the process wherever possible. Payment to third party web hosts for such services, however, must be made by the client. Brighter Web Design will not monitor the rental of domain names on a client’s behalf. All such domain names and web space will be deemed to belong solely to the client and it is the client’s responsibility to see that annual rental payments are made to keep the domain name and web space in their name for as long as is necessary.

7) Brighter Web Design will not be held responsible for break-downs or breaks in service caused by web host companies failing to meet their service commitments.

8) Where a domain name and web space are not bought by the client Brighter Web Design may, at its discretion, offer limited web space for a limited time on its own domain name server. An annual fee will be charged for this service and invoiced for – usually in April or at a time agreed with by the client and Brighter Web Design – upon every subsequent year that the space is utilized by the client’s web site. As above, Brighter Web Design will not be held responsible for break-downs or breaks in service caused by the web host company failing to meet their service commitments.

9) Brighter Web Design reserves the right to publish on a client’s web site – usually on the home page – a copyright acknowledgement and a text link to www.brighterwebdesign.com. This is industry standard practise. Where this is not possible or is undesirable by the client, this must be stated in advance and Brighter Web Design will reserve the right to add such information within the Meta tags of the web page’s html code instead. Such tags will not be visible to 'normal' visitors to the site.

10) Brighter Web Design reserves the right to publish a text link and screen-capture graphic of a client’s web site on its own portfolio web site - www.brighterwebdesign.com - for marketing and advertising purposes.
